The publication is a scientific monograph which is focused on actual trends in judicial creation of law. Its main attention is dedicated mostly to these topics: fundamental legal-theoretical basis of judicial creation of law, social factors influencing judicial decision-making, judicial creation of law in Czech legal practice (especially in private law). As a methodology the monograph will apply interdisciplinary attitude combinating methods of several disciplines of legal theory and science of civil law.
