System der Rechtsphilosophie in gekürzter Darstellung
Title in English: System of Legal Philosophy in Concise Form
Vladimír Kubeš (1908-1988) - originally a civil lawyer, later a constitutional lawyer and above all a philosopher of law - completed his "supreme work", the System of Legal Philosophy in abridged form, in the 1980s. The book, written in German due to the impossibility of publishing it in socialist Czechoslovakia, systematically discusses legal philosophy. The first part defines its concept and tasks, followed by chapters on the foundations, ontology, theory and axiology of law. The conclusion reflects on the meaning of law and its crucial role for the future of society.
Kubeš was initially associated with the Brno school of normative theory, but later partially abandoned its founding principles to develop his own approach inspired by Schopenhauer, Hegel, and Nicolai Hartmann's theory of strata of being. Although written almost half a century ago, his ideas remain stimulating and offer valuable impulses for contemporary debates on law and its role in society.
